Eligibility Policy
Introduction:ChainGPT, a company incorporated in Saint Vincent and the Grenadines (the “Company”), offers various promotional campaigns to its community. These include, but are not limited to, cryptocurrency token giveaways, AI product credit giveaways, USD or stablecoin giveaways, launchpad whitelist access opportunities, and launchpad tier boost rewards (collectively, the “Campaigns”). This Disclaimers & Eligibility Policy outlines the terms, conditions, disclaimers, and eligibility criteria for participating in any of these Campaigns. By participating in a ChainGPT Campaign, each participant agrees to comply fully with all requirements set forth in this Policy. All Campaigns are subject to the terms and conditions below and are void where prohibited by law.This Policy is a supplement to and should be read in conjunction with ChainGPT’s Terms of Service, Privacy Policy, and Cookies Policy. Participation in any Campaign constitutes acceptance of these documents as well.
General Conditions Applicable to All Campaigns
Know Your Customer (KYC) & Sanctions Screening: All participants must successfully complete ChainGPT’s mandatory KYC verification process (including anti-money laundering (AML) and international sanctions screening) to be eligible to receive any Campaign rewards. ChainGPT utilizes a third-party provider (e.g., Blockpass) to perform identity verification and AML/sanctions checks. Participants who fail to pass KYC, who refuse to provide required identification information, or who are flagged during AML or sanctions screening shall be deemed ineligible and shall forfeit any claim to rewards. Due to confidentiality obligations and data protection laws governing our KYC provider, ChainGPT may be unable to disclose specific reasons for a participant’s disqualification beyond notice of ineligibility. If a participant does not successfully complete KYC or is flagged under any AML/CFT or sanctions list, the participant is automatically disqualified and any claimed or pending rewards are void.
Age Requirement: Participation in any ChainGPT Campaign is limited to individuals who are at least 18 years of age, or the minimum age of majority in their country of residence, whichever is higher. Persons under this age threshold are not permitted to participate or claim any rewards. ChainGPT reserves the right to require proof of age from any participant. Any participant found to be under the required age will be disqualified and barred from receiving any reward.
Jurisdictional Restrictions: Residents, citizens, and persons located in the United States or Canada are strictly prohibited from participating in any ChainGPT Campaign. In addition, residents of other jurisdictions that are restricted for a specific Campaign type (as detailed in the sections below) are not eligible to participate in that Campaign. By participating, each entrant represents and warrants that they are not a resident of and are not located in the U.S., Canada, or any other country or region that is listed as prohibited for the relevant Campaign, and that they are not on any prohibited party list (such as U.N., EU, or OFAC sanctions lists). ChainGPT may require participants to certify their jurisdictional eligibility. Campaigns are void where participation or receiving a reward is prohibited by law. ChainGPT reserves the right to modify the list of prohibited jurisdictions at any time to remain compliant with applicable laws and regulations.
Compliance with Local Laws & Taxes: Participants are solely responsible for understanding and complying with all applicable local laws and regulations when participating in a Campaign and when receiving a reward. This includes, without limitation, compliance with any currency exchange controls, registration or licensing requirements, reporting and disclosure obligations, and payment of any taxes, duties, or fees that may apply to the receipt of a reward. ChainGPT makes no representations or warranties regarding the legal status of any reward in any jurisdiction and is not responsible for advising participants on legal or tax matters. Participants should consult their own legal, tax, and financial advisors if they have questions about their obligations. All taxes (if any) imposed on rewards are the sole responsibility of the participant. ChainGPT will not be liable for any failure by participants to comply with their legal or tax obligations.
Reward Distribution: ChainGPT will endeavor to distribute all Campaign rewards to eligible winners promptly after they have met all verification requirements. In some cases, distribution of rewards may take up to 30 days (or such other period as specified for a particular Campaign) from the completion of the winner’s verification process. Participants acknowledge that ChainGPT may, at its discretion, require additional time for distribution due to security, compliance, or operational considerations. ChainGPT is not responsible for any delays caused by third-party processes (for example, blockchain network congestion or KYC provider delays). If a participant fails to provide necessary information for delivery of a reward or cannot be reached after reasonable efforts, ChainGPT reserves the right to deem the reward forfeited.
No Investment Advice or Offer: Participation in a Campaign and any rewards provided (including cryptocurrency, tokens, or launchpad access) do not constitute an offer to sell, or the solicitation of an offer to buy, any securities, nor does it constitute investment or financial advice. ChainGPT does not endorse or recommend any particular project, cryptocurrency, or investment opportunity by offering promotional rewards. All rewards are provided for promotional purposes “as is” with no warranties, and ChainGPT makes no guarantee as to the future value or utility of any reward. Participants should use their rewards responsibly and understand that cryptocurrencies and digital assets carry inherent risks, including volatility, and they participate at their own risk.
Ineligible Persons: Employees, officers, and directors of ChainGPT, its parent company, subsidiaries, affiliates, and any other individuals or entities involved in the implementation or administration of the Campaigns (such as advertising agencies, advisors, and promotional partners), as well as immediate family members (spouse, parents, siblings, and children) and household members of each such person, are not eligible to participate in the Campaigns or receive rewards.
Purchase Requirements for Certain Campaigns: While many of ChainGPT’s promotional campaigns require no purchase or payment to participate, certain specific campaigns (e.g., NFT minting events, AI product credit campaigns, or token sales via ChainGPT’s Launchpad) may require a purchase or payment as part of participation eligibility or to qualify for rewards. Any such requirements will be clearly disclosed in the respective promotional announcement and/or campaign terms. Participants should review individual campaign announcements carefully to confirm eligibility conditions. Participants expressly acknowledge that eligibility to receive rewards in certain campaigns may depend on making a qualifying purchase or payment, and ChainGPT makes no guarantee of reward eligibility without fulfillment of such stated conditions.
Reservation of Rights: ChainGPT reserves the right, in its sole discretion, to disqualify any participant who it finds or suspects to be tampering with the entry process or the operation of a Campaign, acting in violation of this Policy or other applicable terms, or acting in an unsportsmanlike or disruptive manner. ChainGPT also reserves the right to cancel, terminate, modify, or suspend any Campaign (in whole or in part) at any time if, in ChainGPT’s judgment, the Campaign is not capable of running as planned for any reason, including but not limited to fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, or integrity of the Campaign. In such event, ChainGPT may in its discretion cancel any suspect entries or terminate the Campaign without awarding the intended reward, or award the reward in a manner that is fair and in accordance with the spirit of the official rules. All of ChainGPT’s decisions regarding eligibility, compliance with these terms, and interpretation of these rules are final and binding. No correspondence or appeals will be entertained.
Cryptocurrency Giveaway Disclaimer
ChainGPT may occasionally conduct promotional giveaways of cryptocurrency tokens or similar digital assets (“Cryptocurrency Giveaways”). Due to local cryptocurrency regulations and international compliance requirements, residents of certain countries are strictly prohibited from participating in Cryptocurrency Giveaways. Residents of the following jurisdictions may NOT participate in any ChainGPT Cryptocurrency Giveaway:
Afghanistan, Algeria, Bangladesh, Bolivia, Canada, China, Egypt, Iran, Iraq, Morocco, Nepal, Qatar, Tunisia, United States.
Participants are responsible for ensuring that receiving cryptocurrency rewards is legal in their jurisdiction. By participating, each participant acknowledges that they are permitted by their local laws to receive and hold cryptocurrencies. Any participant from a prohibited region (or found to be using VPNs or other methods to bypass geo-restrictions) will be disqualified. ChainGPT does not assume any liability for participants who violate local regulations.
AI Product Credit Giveaway Disclaimer
From time to time, ChainGPT may offer giveaways of credits or access to its AI-based products and services (“AI Product Credit Giveaways”). Due to international export controls, technology restrictions, and sanctions compliance, residents of certain countries are excluded from participating in AI Product Credit Giveaways. The following jurisdictions are NOT eligible to participate in any giveaway of AI product credits:
Afghanistan, Belarus, Canada, China, Cuba, Iran, North Korea, Syria, United States.
Participants must also confirm that they are not listed on any official sanctions or watch list (including but not limited to lists maintained by the United Nations, OFAC, the EU, or other relevant government authorities). Any attempt to participate in an AI Product Credit Giveaway by a sanctioned or otherwise ineligible person is void. Participants acknowledge that they will use any awarded AI product credits in compliance with all applicable laws and regulations, and not for any unlawful purpose. ChainGPT reserves the right to revoke access to AI services if it has reason to believe a participant is misusing the service or violating any law or regulation.
USD/Stablecoin Giveaway Disclaimer
ChainGPT may occasionally run promotional giveaways that award United States Dollars (USD) or equivalent stablecoins (e.g., USDT, USDC) to winners. Due to regulatory, financial, and anti-money laundering restrictions, residents of certain countries are prohibited from participating in any USD or stablecoin giveaways. The following jurisdictions are NOT eligible for USD or Stablecoin Giveaways:Afghanistan, Algeria, Bangladesh, Belarus, Bolivia, Canada, China, Cuba, Egypt, Iran, Iraq, Morocco, Nepal, North Korea, Qatar, Sudan, Syria, Tunisia, United States, Venezuela.
All participants in a USD or Stablecoin Giveaway must ensure that receiving such a reward (whether fiat currency or a stablecoin pegged to fiat) is allowed under the laws of their country. Participants are solely responsible for any bank account requirements or digital wallet requirements to receive USD or stablecoins, and for any currency conversion or reporting obligations. If a participant is unable to receive a USD or stablecoin reward due to local law or lack of required accounts, the reward shall be forfeited. ChainGPT will not provide an alternative prize in such circumstances. Participants also acknowledge that they may be required to provide additional information or pass additional verification (e.g., proof of address or source of funds) before any USD or stablecoin reward is distributed, in order to comply with financial regulations.
Launchpad Whitelist Access Disclaimer
As part of certain promotions, ChainGPT may offer winners whitelist access to upcoming project launches on ChainGPT’s Launchpad (meaning the winner is granted the ability to participate in a token sale or IDO on the ChainGPT Launchpad, subject to the project’s terms). Due to securities laws, token sale regulations, and other compliance considerations, access to Launchpad whitelists is prohibited for residents of certain jurisdictions. The following jurisdictions are NOT permitted to participate in any Campaign offering Launchpad whitelist spots:Afghanistan, Algeria, Bangladesh, Belarus, Bolivia, Canada, China, Cuba, Egypt, Iran, Iraq, Morocco, Nepal, North Korea, Qatar, Sudan, Syria, Tunisia, United States, Venezuela.
Winning a whitelist spot grants the participant the opportunity to join the specified token sale, but does not guarantee any allocation, profit, or protection from loss. Whitelist opportunities are provided on a promotional basis, are non-transferable, and are valid only for the specific project and sale event indicated. They typically remain valid for a limited time or until the respective IDO concludes. Each Launchpad project may impose its own additional requirements or terms for whitelist participants (for example, separate KYC by the project or a requirement to hold a certain cryptocurrency to participate). By accepting a whitelist reward, participants agree to abide by all such project-specific terms. All normal risks associated with token sales (including the risk of loss of investment) apply, and ChainGPT is not responsible for any outcomes of a participant’s decision to partake in an IDO.
Launchpad Tier Boost Disclaimer
ChainGPT’s Launchpad features a tiered system for participants. In some promotions, ChainGPT may temporarily boost a participant’s Launchpad tier status (e.g., elevating a user to a higher tier for a limited period) to increase their benefits or allocation in upcoming Initial DEX Offerings (IDOs). Participation in any temporary Launchpad tier boost promotion is subject to the same jurisdictional restrictions as the Launchpad whitelist above. Residents of the following jurisdictions are NOT eligible for any Launchpad Tier Boost Campaign:
Afghanistan, Algeria, Bangladesh, Belarus, Bolivia, Canada, China, Cuba, Egypt, Iran, Iraq, Morocco, Nepal, North Korea, Qatar, Sudan, Syria, Tunisia, United States, Venezuela.Tier boost rewards are provided for promotional purposes only and have no cash value. A tier boost simply allows the beneficiary to enjoy the privileges of a higher Launchpad tier for the specified upcoming IDO(s) or time period announced by ChainGPT. The boost is temporary and will expire after the designated promotion period or IDO event. Participants should note that a tier boost does not guarantee an allocation in any token sale; it only increases the potential allocation or benefits according to the Launchpad’s mechanics, and participants must still follow all applicable procedures (and accept all risks) when participating in the token sale. All boosted participants are subject to the same responsibilities and risks as any other Launchpad user. ChainGPT assumes no liability for any losses or disadvantages incurred as a result of participating in a token sale under a boosted tier.
Physical Goods & Merchandise Coupon Giveaway Disclaimer
ChainGPT may periodically conduct giveaways involving physical goods (such as merchandise, hardware, apparel, or accessories) and digital or physical merchandise coupons redeemable for ChainGPT or partner merchandise (collectively, “Physical Goods & Merchandise Coupon Giveaways”). Participation in such giveaways is subject to additional terms and disclaimers outlined below.
Eligibility and Jurisdictional Restrictions:Due to shipping restrictions, international trade compliance, customs regulations, and logistics considerations, participation in Physical Goods & Merchandise Coupon Giveaways may not be available to residents in certain jurisdictions. At a minimum, residents of the following jurisdictions are strictly prohibited from participation in giveaways involving physical goods or merchandise coupons:
Afghanistan, Belarus, Canada, China, Cuba, Iran, North Korea, Russia, Sudan, Syria, United States.
Participants should note that global events—such as wars, geopolitical developments, changes in international sanctions, embargoes, or shipping disruptions—may further impact ChainGPT’s ability to deliver physical items to certain locations. If at any point a participant’s location becomes undeliverable due to these circumstances, the participant shall become ineligible, and the reward will be forfeited without compensation or alternative rewards offered.
Additional jurisdictional restrictions may apply based on individual giveaway terms. Participants must carefully review the campaign announcements to confirm eligibility.
Shipping and Delivery:
- ChainGPT will cover reasonable shipping costs for the delivery of physical rewards to eligible participants. However, winners are solely responsible for any additional fees, customs duties, import taxes, VAT, or any other local taxes and charges applicable in their country of residence.
- Participants must provide complete and accurate shipping information within a timeframe specified by ChainGPT. Failure to timely or accurately provide requested shipping details may result in forfeiture of the prize.
- ChainGPT is not responsible for items lost, stolen, damaged, delayed, or destroyed during shipping. Participants acknowledge that ChainGPT’s obligation to deliver the physical reward ends upon successful dispatch with a reputable carrier.
- ChainGPT reserves the right to substitute a reward with another of equal or greater value in the event of unavailability or logistical challenges.
Merchandise Coupons:
- Merchandise coupons may be digital or physical and are valid only for the redemption period specified in the campaign announcement. Expired coupons hold no value and will not be replaced.
- Coupons are non-transferable, non-refundable, and have no cash value.
- Merchandise coupons may only be redeemed through official ChainGPT channels or designated partners. Participants agree to comply with redemption rules and procedures detailed at the time of issuance.
- ChainGPT reserves the right to limit coupon usage per individual, household, or account as indicated in the campaign terms.
Warranty and Liability:
- Physical goods are provided “as is” and without warranties of any kind, either expressed or implied. ChainGPT expressly disclaims any warranty of merchantability, fitness for a particular purpose, or non-infringement related to any physical items awarded.
- Participants agree that ChainGPT, its affiliates, employees, directors, suppliers, partners, or agents shall not be liable for any damages, losses, injuries, or inconveniences arising directly or indirectly from the acceptance, possession, use, or misuse of physical rewards or merchandise coupons.
Responsibility for Compliance: Participants acknowledge sole responsibility to ensure their eligibility and legal right to participate in giveaways involving physical goods and merchandise coupons under applicable local laws and regulations. ChainGPT shall not be liable for participants’ failure to comply with such requirements.
Liability Waiver and Release
By participating in any ChainGPT promotional Campaign, participants agree to release, discharge, and hold harmless ChainGPT, its parent company, affiliates, subsidiaries, officers, employees, agents, and advisors (the “Released Parties”) from any and all claims, actions, injuries, liabilities, losses, or damages of any kind (including, without limitation, direct, indirect, incidental, consequential, or punitive damages) arising out of or in connection with participation in the Campaign or the receipt, use, or misuse of any reward. To the fullest extent permitted by applicable law, participants waive any right to file a lawsuit or assert a claim against the Released Parties arising from the Campaign or any reward received through the Campaign. Participants specifically waive the right to seek injunctive relief, to participate in or initiate a class action, and to pursue any punitive or exemplary damages against the Released Parties. If notwithstanding this waiver a participant is found to have a viable claim against ChainGPT or any other Released Party, the total cumulative liability of the Released Parties shall be limited to the actual value of the reward that was or should have been awarded to that participant. In no event will the Released Parties be liable for any losses in excess of the value of the advertised reward, and in no case will the Released Parties be responsible for any lost profits or investment losses.
Participants also agree to indemnify and hold harmless ChainGPT and the Released Parties from and against any claim, demand, liability, damage, loss, or expense (including attorneys’ fees and costs) arising out of or relating to the participant’s violation of this Policy, the participant’s violation of any law or regulation in connection with their participation, or any false representations made by the participant in the course of participating in a Campaign.
All participants acknowledge that they are participating in the Campaigns at their own risk. The Released Parties make no warranties, express or implied, in fact or in law, with respect to any aspect of the Campaign or any rewards, including but not limited to quality, merchantability, or fitness for a particular purpose.
Any dispute or claim arising out of or in connection with a Campaign or reward shall be governed by the dispute resolution and arbitration provisions of ChainGPT’s Terms of Service, which include a waiver of class action rights. By participating, each participant agrees to resolve any such disputes on an individual basis in accordance with those Terms of Service.
Policy Amendments
ChainGPT reserves the right to modify or update this Disclaimers & Eligibility Policy at any time in order to maintain compliance with evolving international laws and regulations or to address changing operational needs. Any amendments will be effective as of the date of posting the revised Policy on the official ChainGPT website. It is the participant’s responsibility to review this Policy periodically for updates. Continued participation in any Campaign after any changes to this Policy constitutes acceptance of the revised terms.
